Welcome to danyluk-studio.com. These Terms & Conditions outline the rules, responsibilities, and expectations when booking photography services with Bohdan Danyliuk (“Photographer,” “we,” “us,” “our”). By hiring the Photographer or using this website, you agree to the following terms.

1. General Provisions

1.1. These Terms & Conditions apply to all photography services offered by the Photographer, including weddings, engagements, portrait sessions, and all related services.
1.2. The Photographer reserves the right to update or modify the Terms & Conditions at any time. Changes take effect immediately once published on the website.
1.3. By booking a service, the client confirms they have read, understood, and agreed to these Terms & Conditions.

2. Booking and Payment

2.1. A 20% non-refundable retainer is required to secure the date of the photo session or wedding.
2.2. The remaining 80% balance is due on the day of the photoshoot (or as otherwise agreed in writing).
2.3. Date reservations are confirmed only after the retainer has been received.
2.4. Prices listed on the website may change; however, the price agreed upon at the time of booking remains fixed.

3. Cancellations and Rescheduling

3.1. If the client cancels the booking, the retainer is non-refundable.
3.2. Rescheduling due to weather, emergency, or unforeseen circumstances is allowed if the Photographer has availability.
3.3. If the Photographer becomes unable to perform the service due to illness, emergency, or circumstances beyond control, the client will be offered:

  • a replacement photographer of similar style or

  • a full refund of all payments made.

The Photographer’s liability is limited to the amount paid.

4. Duration of Photoshoot

4.1. Each package includes a specific amount of shooting time.
4.2. Travel between locations, short breaks, and logistical pauses count toward the total time.
4.3. If the client arrives late, the Photographer cannot guarantee the full number of photos stated in the package.
4.4. If the ceremony and reception occur on different days, separate arrangements and pricing apply.

5. Editing and Delivery

5.1. The Photographer provides the number of edited photos specified in the chosen package.
5.2. Clients acknowledge the Photographer’s style, color grading, and artistic approach as shown in the portfolio.
5.3. Selection of images for editing is performed exclusively by the Photographer.
5.4. RAW files are not included but may be purchased for an additional fee.
5.5. Final edited images are delivered within 14 calendar days unless otherwise stated.
5.6. Delivery is made via an online file-sharing platform or gallery system.

6. Copyright and Usage Rights

6.1. Copyright for all images remains with the Photographer.
6.2. The Photographer retains the right to publish images for portfolio, website, advertising, and social media purposes.
6.3. If the client wishes to restrict public use of their images, an additional $500 privacy fee applies.
6.4. Clients receive a non-exclusive personal license allowing them to download, share, and print photos for personal use.
6.5. Commercial use or resale requires written permission.

7. Client Responsibilities

7.1. The client is responsible for:

  • securing permissions for shooting locations

  • ensuring all participants arrive on time

  • maintaining a safe environment for the Photographer and equipment
    7.2. The Photographer is not responsible for missed shots due to interference, time delays, or restrictions imposed by venues.

8. Photographer Responsibilities

8.1. The Photographer agrees to:

  • provide professional-quality photography

  • use reasonable skill and care

  • deliver photos within the agreed timeframe
    8.2. While every effort is made to produce high-quality work, artistic results are subjective and cannot be guaranteed identically to sample references.

9. Liability

9.1. The Photographer is not responsible for:

  • weather conditions affecting the shoot

  • accidents or injuries occurring during the session

  • acts of nature, equipment malfunction, or data loss beyond reasonable control
    9.2. In the unlikely event of total image loss, the Photographer’s liability is limited to the total amount paid by the client.

10. Privacy and Data Protection

10.1. Personal data (name, email, phone, etc.) is used only for communication and service delivery.
10.2. Data is never sold or shared with third parties except as required by law.

11. Dispute Resolution

11.1. All agreements are governed by the laws of Alberta, Canada.
11.2. Any disputes shall be resolved through negotiation and, if necessary, mediation before legal action.
